Weird Virginia Beach Laws: A Warning for Anyone Going Out to Have a Fun Time
Since I have been running this site I have been trying to keep up-to-date on all the Virginia Beach legal info and lets say I found out a stunning law. If you like to go out and drink you may want to consider the following:
If the driver of the car that you are in is suspected of a DUI and you are the passenger you may also be charged with a DUI
How in the world do they pass laws like this seriously? Who would vote for this… I mean ok the person driving if over the legal limit does deserve a DUI, but no the passengers in the car. In order to get a DUI in the state of Virginia You have to meet the following:
If you are operating or in control of a vehicle and are over the BAC limit (.08) you are considered to be DUI and will be charged thus.
If you are the passenger of the vehicle and you are intoxicated, even if well above the limit, you still are not operating the vehicle. If anything if you are below the limit and letting someone who is above the limit drive THEN you should be charged with a crime, but not if you are over the limit and not even operating the vehicle… Thats just Virginia Beach trying to squeeze some extra cash out of the general public. There would be a fight in the courtroom before I get charged with a DUI and I wasn’t driving.
